WheelPass terms for learners
Last updated: [date]
1. About these terms
WheelPass is an app that helps learner drivers find, book and pay driving instructors, keep track of their progress, and practise for the theory test. [Business name], [company number], [address] ("WheelPass", "we", "us") runs it. By creating an account you agree to these terms. If you do not agree, please do not use WheelPass.
You must be 16 or over. If you are under 18 you can use WheelPass, and your instructor will be told you are under 18 when you ask for a lesson. We encourage you to tell a parent or carer that you are using it.
2. What WheelPass is, and what it is not
- We are a platform, not a driving school. The lessons are given by independent instructors. They, not WheelPass, are responsible for the teaching, the car and their insurance. A lesson is an agreement between you and the instructor.
- We do not take your money. You pay your instructor directly (bank transfer, a payment link, or cash if they accept it). WheelPass never holds or moves your money. We keep a record of what was booked and what you say you paid, and the instructor confirms what they received.
- We do not settle disagreements about money. If you and an instructor disagree, talk to them in the chat. We can look at reports of fraud, abuse or unsafe behaviour, but we do not decide who owes what.
- "Verified" means one thing. The verified badge means we have checked that the instructor appears on the DVSA register of approved driving instructors with a badge that is in date. It does not mean we have checked anything else about them, and it is not a promise about the quality or safety of their lessons.
3. Booking lessons
- Asking for a lesson reserves nothing. The time is reserved when the instructor approves it. Several people can ask for the same time.
- You see the price before you ask. It is fixed when you ask, even if the instructor changes their rate later.
- A request lapses if the instructor does not answer in time (48 hours, or 12 hours before the lesson if sooner).
- You can have up to five requests waiting at once, and one active instructor at a time. To change instructor, end the current connection first.
- You can ask for a repeating series of lessons. The instructor can approve all of it, some dates, or none.
- All times are UK time.
4. Paying
- Pay by the method the instructor shows. Check the details in the app every time. Only pay to details you can see in WheelPass. If anyone asks you to pay somewhere else, do not, and report it.
- After you pay, tap "I've paid". The instructor confirms. A confirmed payment locks the lesson in.
- An unpaid lesson that you have not marked as paid is released at the deadline the instructor sets (24 hours before by default).
- If your instructor lets you pay after the lesson, you must pay within [a week] of the lesson; until you do you cannot book more with them.
5. Cancelling
- You can cancel a request that has not been approved at any time, free.
- You can cancel an approved lesson. Each instructor sets a cancellation window (24 hours by default). Cancel inside the window and the instructor can decide to keep the money for that lesson, carry it over as credit, or refund it. The cancel screen tells you before you confirm.
- If the instructor cancels, anything you paid for that lesson goes back on your balance as credit, and the instructor owes you a refund if you ask.
- Refunds are between you and the instructor. The instructor marks the refund as sent and you confirm you received it. Until you confirm, the credit stays on your balance. A refund you do not confirm within 14 days is closed.
- Packages of lessons have the price and any expiry shown before you buy. Credit that expires is shown to you clearly beforehand. [Lawyer: check against consumer law.]
- If you have a right to cancel under consumer law, nothing in these terms takes it away. [Lawyer to complete.]
6. Reviews
You can review an instructor once you have had at least five paid lessons with them over more than five weeks (or ten lessons, or after you tell us you passed). One review for each instructor. You can edit it for 14 days. Reviews must be honest, about your own experience, and not offer or accept anything in return. Instructors can reply, and either of you can report a review. We may hide a review that breaks the community guidelines.
7. Your behaviour
Follow the community guidelines. Keep your messages with your instructor in the app. Do not share another person's details. We may suspend or close an account that puts people at risk or breaks these terms, and we may tell the police or the local authority if we think a child or adult is at risk.
8. Theory practice
Theory practice is free and does not need an instructor. The questions are written for WheelPass from the Highway Code and published DVSA guidance. They are practice, not the real test, and doing well in them does not guarantee you will pass.
9. Your data
How we use your information is in the privacy policy. You can download your data or delete your account at any time in the app (Home, Privacy and your data).
10. If something goes wrong
- WheelPass is provided as it is. We work to keep it available, but cannot promise it will always be. Because the lessons are given by independent instructors, we are not responsible for what happens in a lesson, or for what an instructor does or does not do.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, fraud, or anything else the law does not allow us to limit. [Lawyer to complete.]
- Our total responsibility to you for anything that goes wrong with the app itself is limited to [amount]. [Lawyer to complete.]
11. Changes, and the law
We may change these terms. We will tell you in the app before important changes take effect. If you carry on using WheelPass afterwards you accept them. These terms are governed by the law of [England and Wales]. [Lawyer to complete: complaints, dispute resolution, consumer rights.]
