WheelPass terms for instructors

Last updated: [date]

1. About these terms

These terms are between you and [business name], [company number], [address] ("WheelPass"). They apply when you create an instructor account and while you use it. You are a self-employed, independent driving instructor. WheelPass is not your employer and you are not our employee, agent or partner.

2. Who can be an instructor on WheelPass

You must be an approved driving instructor (ADI) on the DVSA register with a current badge, and you must be able to lawfully teach. We check your badge against the register before you are listed, and we check again when it nears expiry. You must tell us at once if your registration changes, lapses or is removed, or if you are investigated, suspended or barred. If your badge expires you are unlisted automatically.

What "verified" means. The verified badge means WheelPass has checked that you are on the DVSA register with a badge that is in date. It means nothing more. You must not say or suggest that it means anything else, including that WheelPass has carried out background, safety or quality checks. [Lawyer: confirm this wording about what is and is not checked.]

3. What WheelPass provides

A way to be found by learners, receive and answer lesson requests, manage your diary, record lessons and progress, and be paid by your learners. WheelPass does not take, hold or move money. Learners pay you directly. You confirm what you have received. WheelPass keeps a record and does not settle disputes about money.

4. Your responsibilities

5. Conduct, children and safeguarding

Some learners are 16 or 17. By accepting these terms you agree to the instructor code of conduct:

  1. Keep communication with learners in the app. Do not contact a learner under 18 by private message, social media, or phone for anything other than the lesson arrangements the app supports.
  2. No private or personal contact with a learner under 18 outside what is needed for lessons. No gifts or favours.
  3. Pick-ups and drop-offs only at the place and time agreed in the app. Treat every learner with respect and professionalism.
  4. Never be alone in the car with a learner in a way that makes either of you unsafe or uncomfortable; stop the lesson if you feel it is not appropriate.
  5. Report any concern about a learner's safety to WheelPass using the report tool, and to the police or local authority where the law or common sense says so. If someone is in immediate danger, call 999.
  6. Never pressure a learner about payment, reviews or booking.
  7. Co-operate with any safeguarding investigation. We may suspend you without notice while we look into a concern. Suspension is not a finding.

6. Reviews

Learners can review you only after five paid lessons over more than five weeks (or ten lessons, or after they tell us they passed). You may reply publicly and you may report a review that is false or abusive. You cannot delete or hide reviews, and you must not offer or accept anything in return for a review.

7. Sponsored placements

If we offer paid promotion, it is always labelled "Sponsored", it never changes the organic ranking underneath, and it appears only where you cover the learner's area. Terms for any paid placement are agreed separately. [Business to complete.]

8. Data

You will handle learners' personal data (names, addresses, messages, progress) only to teach them and run your business, keep it safe, and delete it when you no longer need it. For that data you are a controller in your own right. [Lawyer: controller and processor roles.]

9. Ending

You can close your account at any time (Privacy and your data in the app), once you have settled what you owe learners. We may suspend or end your account if you break these terms, your registration lapses, or a safety concern arises. Upcoming lessons are cancelled and learners are told that you are no longer available, not why.

10. Liability and the law

WheelPass is provided as it is. We are not responsible for lessons, payments between you and learners, or your insurance. Nothing here limits liability the law does not allow us to limit. [Lawyer to complete: limits, indemnity, governing law ([England and Wales]).]
